In accordance with Article 52 of Legislative Decree September 6, 2005, No. 206 (“Consumer Code”), you have the right to withdraw from the contract signed with Pellicceria Mele 1880 Srl (the “Seller”) without any penalty and without providing any reason, within 14 days from the day you received the products purchased on fureco.it.
In accordance with Article 54 of the Consumer Code, you may exercise the right of withdrawal in one of the following ways: a) Online transmission of the completed Return Form to the Seller; the Seller will confirm receipt by email; b) Sending the Return Form to the Seller by post, in compliance with Article 49, paragraph 4, of the Consumer Code; c) Sending another explicit declaration of your decision to withdraw from the contract to the Seller by post.
For options b) and c), your declaration should be sent to the Customer Service at the registered office of Pellicceria Mele 1880 Srl, located at Piazza Bovio n.22 80138 Naples. It is understood that in these cases, the burden of proof for correct and timely exercise of the right of withdrawal lies with you.
In accordance with Article 57 of the Consumer Code, once you have exercised your right to withdraw, you must deliver the products to the courier within fourteen (14) days from the date on which you communicated your decision to the Seller.
According to Article 59 of the Consumer Code, the right of withdrawal does not apply to customized or made-to-order products.
Conditions for Exercising the Right of Withdrawal
The right of withdrawal is considered properly exercised if the following conditions are fully met:
- You must exercise the right within 14 days of receiving the products using one of the methods indicated above;
- The products must not have been used, worn, washed, and must comply with the requirements listed in Article 3 below regarding the checks on returned products;
- The identification tag must still be attached to the products;
- The products must be returned in their original packaging;
- The products must be delivered to the shipper within 14 days from the communication of your withdrawal;
- The products must not be damaged.
If you have met all the required conditions, the Seller will fully refund you the price of the products purchased, except for the return shipping costs, unless the Seller has expressly exempted you from these costs at the time of purchase.
Checks on Returned Products
You will be contacted if your return cannot be accepted because it does not comply with the conditions in the previous paragraph, or in case of exceptions according to Article 59 of the Consumer Code. In this case, you may choose to have the products returned to you at your expense. If you refuse this shipment, the Seller reserves the right to retain the products and the amount paid for the purchase.
Timing and Methods of Refund
After receiving your return and checking that all requirements have been met, you will receive an email confirming the acceptance of the return, and the Seller will proceed with the full refund or, if applicable, inform you of the reduced amount due to diminished value of the returned products.
Defective or Non-Conforming Products
You can return a product if it’s defective or not as ordered, by informing the Seller within 30 days from the day you received the purchased products. The Seller will fully refund you, including shipping costs and costs incurred for returning the products.
Conditions for Exchanging Products
In some cases, you may exchange products for the same model but in different sizes and/or colors. All conditions for exchanges must be met, as described in detail above.
